ROME MONUMENT MINTER COMPANY – SALES AGREEMENT
This Agreement certifies that the undersigned (“Purchaser”) has entered into a contract with Rome Monument Company (“Seller”) for the monument work described herein and agrees to pay the total amount outlined in this Agreement.
A minimum of fifty percent (50%) of the total purchase price is due at the time of ordering. The remaining balance must be paid in full upon arrival of the memorial at Seller’s shop and before any engraving or installation begins.
No memorial will be engraved, delivered, or set until paid in full.
ALL SALES ARE FINAL. NO REFUNDS WILL BE ISSUED ONCE A MEMORIAL HAS BEEN PLACED ON ORDER.
It is understood and agreed that all work described herein shall remain the property of Rome Monument Company until paid for in full. The Purchaser hereby waives all rights of exemption secured under the laws and courts of the State of Georgia.
In the event of nonpayment or default exceeding ninety (90) days, Rome Monument Company is authorized to enter upon the cemetery lot and remove the memorial without liability for any damages resulting from such removal. Upon removal, the memorial becomes the exclusive property of Rome Monument Company.
All payments made prior to default shall be retained by Seller as compensation for costs incurred.
The Purchaser further authorizes cemetery authorities to accept Seller’s sworn statement of default as sufficient permission to allow removal.
If the Purchaser fails to maintain contact, provide required approvals, or otherwise move forward with the order for a period of six (6) consecutive months, the order shall be considered inactive.
Seller will make reasonable, documented efforts to contact the Purchaser using the last known contact information on file. If Purchaser fails to respond within thirty (30) days after written notice (via mail, email, or other documented communication), the order shall be deemed abandoned.
Upon abandonment:
Seller shall not be liable for any loss resulting from such abandonment.
If a cemetery foundation fee is included and exceeds the estimated amount, Purchaser agrees to pay any additional charges.
Where cemetery authorities retain the right to furnish foundations, an order shall be considered complete when the memorial is delivered to the cemetery and the foundation has been ordered.
SELLER IS NOT RESPONSIBLE FOR DELAYS CAUSED BY THE CEMETERY.
Any stated completion or turnaround time is an estimate only. Our estimated completion time for ALL orders is 6-8 months from the date of purchase. Completion may be delayed due to circumstances beyond Seller’s control, including but not limited to:
Such delays shall not constitute a breach of contract.
A layout/design proof will be provided to the Purchaser for approval prior to engraving.
No work will begin until written approval is received. If Purchaser delays in approving the design, any resulting delay in production or installation shall extend the estimated completion timeline and shall not be the responsibility of Rome Monument Company.
Please allow up to 120 days for inscription work to be completed. From November 1 through March 31, completion may be further delayed due to weather conditions.
Engraving additional lettering on an existing memorial requires precise conditions and may be delayed due to the following:
WEATHER:
Engraving cannot be performed on wet, damp, or snow-covered surfaces. Extended periods of rain or moisture will delay completion.
TEMPERATURE:
Engraving cannot be completed when temperatures are below 32 or above 90°F due to material limitations.
Seller is not responsible for:
If any balance remains unpaid thirty (30) days after the due date, interest may be charged at a rate of 14% per month until paid in full.
In the event of default requiring legal action, Purchaser agrees to pay all reasonable attorney’s fees, court costs, and collection expenses incurred by Seller.
Purchaser may cancel this Agreement within three (3) business days without penalty. After that period, cancellation requires mutual written agreement of both parties.
This Agreement constitutes the entire understanding between the parties and may only be modified in writing signed by both Purchaser and Seller.
By continuing with memorial purchase, Purchaser affirms that they are the rightful owner of the cemetery lot, heir, or authorized representative with full authority to approve and authorize this work.
